FLOURITY
Privacy Policy
Effective Date: April 27, 2026
1. Scope
This Privacy Policy explains how FLOURITY LLC, a Texas Limited Liability Company ("FLOURITY,"" "we," "us," or "our"), collects, uses, discloses, retains, and otherwise processes personal information when a "visitor" or "user" (also "you") accesses or uses the FLOURITY mobile app, website, and related services (collectively, the "Services").
If you have any questions about this policy or how we use your information, please reach out to privacy@flourity.app.
We use the term, "Personal Information" to include information about an individual or household. It encompasses the information described in section 2 below and includes but is not limited to things such as names; contact information like physical addresses, email addresses, and phone numbers; personal characteristics; personal identification numbers; device ID numbers; and third-party identifiers. In some jurisdictions the same information is identified as "personal date," "sensitive personal data," "personally identifiable information," or "non-public personal information." We consider these terms to be interchangeable.
Because the Services involve relationship and wellness-oriented features, some information processed through the Services may be sensitive in context even if it is not regulated health information. We therefore encourage users to be thoughtful about what they share. We will not have access to sensitive therapy information unless you provide that in what you share.
By using the Services, you accept and agree to both the Privacy Policy and the Terms of Use. Please read both carefully. If you do not agree, do not use the Services.
2. Categories of Personal Information that we collect
The exact Personal Information collected depends on how you use the Services, which features you enable, whether you connect with a partner, what device and permissions you use, and whether you interact with customer support or pilot programs.
Information that You Provide
- Account and profile information, such as your name, age, address, email address, phone number, username, password or authentication credentials, profile photo if added, relationship status selections, insurance information (if applicable) and account preferences.
- Relationship participation information, your preferences, your interests, whether you use the app as an individual or as part of a couple, whether you send or accept a partner invitation, link status, role labels within a shared experience, and settings for shared features.
- Check-in, reflection, and activity information, such as responses to prompts, journal-style entries, check-ins, exercises completed, habit participation, streaks, educational content viewed, and feature usage history.
- Communications and support information, such as messages you send to us, responding to our emails and messages, support tickets, survey answers, feedback, bug reports, and pilot-program communications.
- Payment and transaction information, if you purchase paid features, such as subscription status, billing dates, and limited payment metadata provided by payment processors or app stores. Flourity may not receive your full card number.
- If you enable biometric authentication or similar biometric functionality, the App may collect and process biometric data solely to recognize and verify your identity for security, fraud prevention and detection, and access control (including enabling the user to gain access to restricted areas or features of the Services). Where enabled, biometric data may be collected and processed through computer-based systems that can scan and analyze the user's face, finger, or hand physical features to generate unique data points and/or unique mathematical representation used by an algorithm to identify or verify the user's identity. To the extent that biometric data is processed by a service provider operating on Flourity's behalf, such processing will be limited to the purposes stated in this section and subject to contractual obligations requiring confidentiality, appropriate security safeguards, and use restrictions consistent with this policy. If Flourity begins collecting or using biometric data in connection with biometric functionality for any purpose beyond those stated in this section, Flourity will update this Privacy Policy accordingly before such additional purpose is implemented, to the extent required by applicable law.
- Relationship status and content you voluntarily submit, including any notes, journal entries, free-text answers, uploaded materials, or other content you choose to store or transmit through the Services.
Information Generated by the Service
- Scores, trends, and inferred indicators generated from your activity, such as engagement summaries, completion rates, patterns, trends over time, and informational relationship or personal development scores.
Information Collected Automatically
- Visitor information like the device used, log, and technical information like Internet Protocol (IP) address, approximate location derived from IP, device identifiers, operating system, app version, internet service provider, language, time zone, push token, crash data, performance logs, and other diagnostic information, analytics and user data, screens or pages viewed, taps, session timing, referral source, campaign data, and interactions with features, notifications, or emails. Depending on your device settings, we may gather external identifiers and internal identifiers.
3. Information we may receive from other sources
We may receive information from app stores, identity providers, payment processors, analytics vendors, hosting providers, customer-support tools, marketing partners, or a partner you connect with in the Services. For example, if your partner invites you into a shared experience, we may receive your invitation acceptance and linked-account status.
4. How we Use Personal Information
We use Personal Information for the following business and commercial purposes:
1. To provide, maintain, personalize, secure, and improve the Services.
2. To create and manage accounts, authenticate users, and enable app functionality.
3. To operate single-user and couple-linked features, including shared views, prompts, exercises, trend displays, and informational scoring outputs.
4. To communicate with you about service updates, confirmations, billing, support matters, and important notices.
5. To send marketing or promotional communications where permitted by law and consistent with your preferences.
6. To monitor performance, debug errors, prevent fraud, investigate abuse, enforce our agreements, and protect users, FLOURITY, and the public.
7. To analyze app usage and product performance, develop new features, and conduct internal research and reporting.
8. To comply with legal obligations, respond to lawful requests, exercise legal rights, and resolve disputes.
9. To create aggregated or de-identified information where permitted by law.
5. When we disclose or share information
We may disclose personal information in the following circumstances:
- Service providers and contractors that host, process, support, analyze, or secure the Services on our behalf, subject to contractual restrictions where appropriate.
- From time-to-time employees may need to handle your Personal Information for support services or to comply with the law. Employees are held to a standard of strict confidentiality.
- App stores, payment processors, authentication vendors, customer support providers, communications vendors, analytics and reporting providers, and other vendors you interact with through the Services.
- Professional advisors, lawyers, CPAs, auditors, investors, acquirers, and financing sources in connection with due diligence, financing, or a business transaction, subject to confidentiality protections where appropriate.
- Law enforcement, regulators, courts, or other third parties when we believe disclosure is necessary to comply with applicable laws, regulations, legal processes, government requests, protect rights or safety, or investigate wrongdoing.
- In connection with a merger, acquisition, reorganization, sale of assets, financing, or similar transaction, or in the event of insolvency, bankruptcy, or receivership, information may be transferred as part of the business assets, subject to the commitments set forth in this Policy or a successor policy of at least comparable protection.
- Other parties with your consent and at your direction. When you direct us to disclose specific content to your licensed therapist or another third-party (for example by using the couple-linked features), we may disclose such Personal Information consistent with your instructions. Such disclosures are made at your request and direction. Once disclosed to your licensed therapist or another third-party, their handling of the information is governed by their own private practices and not by this policy. We strongly encourage users in a couple-linked arrangement to discuss and agree on how couple-linked Personal Information will be shared with any licensed therapist, particularly where both partners are in therapy or where shared sessions are being conducted.
6. How couple-linked features work
If you choose to participate in a linked or shared experience with another person, FLOURITY may share certain information with the linked participant. Depending on product settings, this may include whether actions were completed, certain responses or summaries, activity history, scores or trends, or content intentionally shared into the joint experience. We may provide indicators or settings (where available) specifying whether particular entries, assessments, messages, or exercises are private to one user, shared with the linked partner, or jointly created and visible to both. You should review and understand these visibility indicators before entering information that you may not wish to share with your partner.
You should assume that any content or signal expressly shared into a joint experience can be seen by the linked participant. FLOURITY cannot guarantee that another participant will not copy, screenshot, export, or otherwise preserve information that they can access.
If a linked relationship is later disconnected, FLOURITY may continue to retain records needed for operational continuity, fraud prevention, security, legal compliance, dispute handling, and backup restoration windows.
7. Sensitive-context and health-adjacent information
FLOURITY is not, by default, acting as a covered entity or business associate under HIPAA in providing the Servies as self-guided consumer tools. If your licensed therapist independently incorporates information from the Services into your clinical record, that information may become protected health information (PHI) governed by your licensed therapist's own privacy practices and any applicable federal or state healthcare privacy laws. We do not control your licensed therapist's handling of such PHI. If, in the future, we enter into a business association with a healthcare provider or organization, and the Services are used as part of that provider's clinical services: 1. Additional HIPAA-related terms and notices may apply, and 2. Such terms will be provided separately and may supplement or modify how certain information is handled in that context.
The Services are intended for wellness, education, and relationship-support use. Even so, some Personal Information handled through the Services may relate to emotions, relationship conflict, habits, or other intimate matters. We treat this context seriously. Some Personal Information collected by FLOURITY is covered by consumer-health or health-adjacent privacy and data laws in some states.
8. Cookies, mobile identifiers, and analytics
In order to offer and provide a customized and personal service, we and our vendors may use cookies, SDKs, pixels, local storage, mobile identifiers, and similar technologies to remember preferences, keep you signed in, measure performance, understand usage, prevent fraud, and support marketing or attribution efforts. Your browser or device may let you manage some of these settings. Certain analytics or advertising technologies may continue to process data unless disabled through available controls. By using the App, you consent to the use of cookies and similar technologies in accordance with this Privacy Policy.
9. Uses of Artificial Intelligence
We use artificial intelligence (AI) and AI algorithms to support features within the Services. These features use prompted responses only and do not draw from Personal Information outside of those closed question and response sets. Questions include reference to location and AI is used to match the user with certain options within that geographic location.
10. Data retention
We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide and operate the Services, maintain relationship histories you choose to keep, comply with legal obligations, resolve disputes, prevent fraud and abuse, enforce agreements, and maintain backups and logs.
Retention periods may vary by data type, account status, legal requirements, security needs, and whether information has been de-identified or aggregated.
You may request deletion of your account as described below. Subject to applicable law and legitimate business needs, we will delete or de-identify information associated with your account within a commercially reasonable period, except where retention is required or permitted for compliance with legal obligations, security, fraud prevention, abuse detection purposes, or record keeping to the extent reasonably necessary to protect our rights.
If you are part of a couple-linked account and you request deletion of your account, we may delete or de-identify your direct identifiers or access credentials. Certain content that forms part of the other user's records (for example messages visible in their account or jointly created entries) may be retained in that other user's account to preserve the integrity of their records and experience with the Services. Where feasible, we may modify such content to reduce the amount of Personal Information directly attributable to you, while maintaining the functionality of the remaining user's account.
11. De-identification and Aggregation for Product Improvement
FLOURITY may create de-identified or aggregated data derived from collected data for purposes of improving features of the Services. FLOURITY will only use such data in a manner intended to prevent re-identification. FLOURITY and its vendors or service providers will not attempt to re-identify de-identified data except ss necessary to test the effectiveness of de-identification measures or as otherwise permitted by applicable law.
11. Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no method of transmission, storage, or security control is completely secure, and we cannot guarantee absolute security.
12. Your choices and rights
Depending on where you live and how you use the Services, you may have rights or choices regarding your Personal Information. We may ask you to verify your identity before processing a request to change or delete your Personal Information or your account.
- Access and correction. You review, correct, or update certain account information through settings in the app or by contacting us.
- Marketing and communication preferences. You can opt out of marketing emails using the unsubscribe link and may manage push notifications through your device settings. We may send you service-related communications that are necessary for the functioning of the Services or for legal or security reasons and which you may not be able to opt out of. For other communications, where applicable, you may opt out by following unsubscribe instructions in the communication or by adjusting settings within the app.
- Account deletion. You may request deletion of your account and certain associated information through available in-app tools or by contacting us. We may retain certain information as permitted or required by law, for security, fraud prevention, dispute resolution, backup restoration, and legitimate business purposes.
- Location- or law-based privacy rights. Depending on applicable law, you may have rights to know, access, delete, correct, port, opt out of certain processing, appeal a denial, or limit certain uses of sensitive Personal Information. We may need to verify your identity before responding.
- Linked-account limitations. When information has already been shared with another participant in a couple-linked feature, deletion from FLOURITY systems may not remove copies, screenshots, exports, or notes already retained by that participant.
- If you have enabled sharing of app content with a licensed therapist via app features, you may be able to modify or revoke such sharing through your settings, subject to technical and contractual limitations. Revoking app-based sharing does not affect copies of information already obtained or incorporated into your licensed therapist's records.
13. Children
The Services are not intended for use by children under the age of eighteen (18). The Services are not directed to children, and FLOURITY does not knowingly collect data from persons under 18. FLOURITY does not knowingly solicit data online from or market to children under the age of 18 in compliance with the Children's Online Privacy Protection Act (COPPA) which identifies children as those under the age of thirteen (13). If we become aware that we have collected such information without verifiable consent where required, we will take reasonable steps to delete it.

15. Changes to this Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors. If changes are material, we will provide notice by reasonable means and update the effective date above. Your continued use of the Services after the updated effective date indicates acknowledgment of the revised Policy.
16. Data Security and Breach Response.
FLOURITY does its best to protect your information from any unauthorized breach, access, misuse, or disclosure. It may allow access to your personal information to its employees, contractors, and service providers that need to know such data to perform necessary services. Personal data will be kept confidential, and employees and/or contractors will only have access to it when necessary. Secure password managers and platforms will be used to manage data access when possible. Should there be a potential breach of personal information, FLOURITY has procedures in place to respond. The breach will be identified, the scope will be determined, and FLOURITY will make reports and/or notification if it is legally required to do so. You acknowledge that the personal information that you voluntarily share could be accessed or tampered with by a third-party. You agree FLOURITY is not responsible for any intercepted information shared through the Services without FLOURITY's knowledge or permission. Additionally, you release FLOURITY, its agents, affiliates, officers, employees, contractors, and members from any and all claims arising out of or related to the use of such intercepted information in any unauthorized manner. 18. Governing Law; Venue; Jurisdiction; Compliance
